Sexual Harassment:

Recently, the U. S. Supreme Court clarified certain aspects of sexual harassment law. The Court made it clear that the employer is always liable if an employee can show that they suffered adverse employment action (e.g., a demotion, discharge, failed promotion or pay cut) due to a supervisor’s sexually harassing behavior, regardless of whether higher officials knew about it.

The Court also stated that when no adverse employment action has occurred, but the employee has been subjected to sexual harassment by their supervisor, the employer will not be liable if the employer can prove both of the following:

bulletThe employer "exercised reasonable care to prevent and correct promptly any sexually harassing behavior."
bulletThe employee "unreasonably failed to take advantage of any preventative or corrective opportunities provided by [the employer] or to avoid harm otherwise."

The times are changing and employers need to continue to take proactive measures to protect their employees and their business from sexual harassment lawsuits.

Recruiting Challenges Today:

Today most major metropolitan areas are faced with a greater demand for employees than are available due to low unemployment. This creates a different challenge in the area of recruitment. In this type of market the "old" ways of recruiting by placing a classified ad in the Sunday paper is not successful any more.

Today you are in a battle to attract applicants who are currently working to come to your business and apply. How do you do that? You have to be creative and develop a multi-faceted game plan using multi-media approaches. A combination of radio, newspaper, telephone, and vehicle advertising will enhance the number of responses that you receive and hopefully provide you with good applicants.

According to recent survey information, the number one reason that applicants chose to apply at one business over others is the reputation of that employer. They contact friends, family or others they know who work at that employer to assess how good of an employer the company is. Is it time to take a look at your company’s reputation in the community? It may also be a factor in your turnover and retention numbers.
